Terms of Use: PocketPodium
1. Who offers what
PocketPodium is a practice tool for talks and presentations, operated by Jonas Hallmann, c/o POSTFLEX PFX-238-021, Emsdettener Straße 10, 48268 Greven, Germany (pocketpodium@hallmann.top, further details in the imprint).
For the paid tier („Premium“), Paddle.com Market Ltd. is our reseller and Merchant of Record: your purchase contract for Premium is with Paddle, and Paddle issues the invoice and handles payment and VAT. Your use of the app itself is governed by these terms between you and Jonas Hallmann.
2. What PocketPodium does
You record a talk, the app transcribes it, measures pace, filler words and pauses, and has an AI write feedback in different coaching roles. That feedback is machine-generated: an estimate, not a verdict and not the truth. It can be wrong, grades in particular. Don't rely on it alone when preparing a talk for a real audience.
3. Account
Sign-in works via an email link, without a password. Keeping your mailbox secure is up to you. An account belongs to one person; Premium is not transferable.
4. Premium: scope, term, cancellation
Premium unlocks additional coach perspectives, every training goal, longer recordings and uploading your own recordings. It runs monthly or yearly and renews automatically until cancelled.
You can cancel at any time: in the app under „⭐ Premium → Manage subscription“, or via the link in your order email from Paddle. Cancellation takes effect at the end of the period you have already paid for; until then your access remains. There is no minimum term beyond the period you paid for.
5. Fair use
Every analysis costs real money (AI and compute). Hence the limits: a maximum length per recording plus a monthly allowance of analyses and minutes. The current values are shown in the app and are set so that daily practice fits comfortably. Systematically exhausting them to run the service in an automated fashion may result in throttling.
6. Withdrawal and refunds (refund policy)
Consumers in the EU have a 14-day right of withdrawal. Because Premium is usable immediately, the service starts at purchase; proportionate compensation could in principle apply for time already used. We waive that as soon as you give a reason or a wish in the withdrawal form: then we refund the full amount with no deduction. Your withdrawal is valid without a reason too; the promise simply comes on top.
Beyond that: if something didn't work or you bought by mistake, message us via the feedback button in the app or at pocketpodium@hallmann.top, we refund without fuss. Refunds are processed by Paddle and go back to the payment method used. Paddle's own refund policy is also linked in your order email.
7. Your recordings and data
What happens to recordings, transcripts and reviews is described in the privacy policy. In short: recordings are deleted after analysis, talks stay private until you explicitly share them. A shared talk is publicly reachable via its link, and sharing can be revoked at any time.
8. What's not allowed
Don't upload content you have no rights to, don't record other people without their consent, nothing unlawful, and no attempts to disrupt the service or circumvent its limits. Serious or repeated violations may lead to account suspension; paid but unused time is refunded in that case.
9. Availability and liability
PocketPodium is a small, self-operated project. We do our best, but there is no guaranteed availability. We are liable only for intent and gross negligence, and for breaches of essential contractual duties, in that case limited to foreseeable damage typical for this kind of contract. Liability under product liability law and for injury to life, body or health remains unaffected.
10. Changes
These terms may change, for instance when new features arrive. We announce changes affecting Premium by email at least 30 days in advance. If you don't object, they apply from the stated date; you may cancel until then. Price changes never apply retroactively to a period already paid for.
11. Law and jurisdiction
German law applies. Mandatory consumer protection rules of your country of residence remain unaffected. The EU online dispute resolution platform is at ec.europa.eu/consumers/odr; we are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not do so.
